Abstract

Clean Air Act (CAA) section 129(g)(1)(C) excludes air curtain incinerators (ACI) that burn only wood waste, yard waste, and clean lumber from the definition of a “solid waste incineration unit” (and associated requirements), provided they comply with opacity standards established by the Administrator by rule. Currently the opacity standards and title V permitting requirements for this type of ACI are inconsistently defined across CAA section 129 rulemakings for four different solid waste incineration unit categories, which has led to uncertainty surrounding rule applicability and title V requirements. To resolve these inconsistencies, we are proposing to issue a consolidated ACI rule. Additionally, the EPA proposes to include in the CISWI rule subparts provisions for the temporary use of CISWI units to combust debris from a qualifying disaster or emergency on a temporary basis without complying with (CAA) section 129 requirements that would otherwise apply to CISWI units for the combustion of commercial and industrial waste during normal operations.
