Abstract
Section 2301 of the Water Infrastructure Improvements for the Nation Act (WIIN Act) of 2016 amended Section 4005 of the Resource Conservation and Recovery Act (RCRA). The WIIN Act provides that States may, but are not required to, develop and submit a Coal Combustion Residuals (CCR) permit (or other system of prior approval) program to EPA for approval. The State of North Dakota is seeking approval of its CCR permit program
