Abstract

Section 14(c) of the Fair Labor Standards Act authorizes the Secretary of Labor to issue certificates allowing employers to pay productivity-based subminimum wages to workers with disabilities, but only where such certificates are necessary to prevent the curtailment of opportunities for employment. The Department of Labor proposes to amend regulations at 29 CFR part 525 to phase out issuance of section 14(c) certificates by ceasing issuance of new section 14(c) certificates to employers; and permitting existing section 14(c) certificate holders, under certain conditions, to continue to operate under section 14(c) certificate authority during a 3-year phase out period.
