Abstract
EPA is announcing the availability of new information and data for EPA’s proposed rulemaking (84 Fed. Reg. 40353, Aug., 14, 2019) on “Hazardous and Solid Waste Management System: Disposal of Coal Combustion Residuals From Electric Utilities; Enhancing Public Access to Information; Reconsideration of Beneficial Use Criteria and Piles”. The Agency is seeking public comment on how, if at all, this additional information should affect the Agency's decisions as it reconsiders the beneficial use definition and provisions for accumulations of CCR destined for beneficial use or disposal. The information is now available in the docket for this Notice; it consists of the data and information the Agency received in response to the 2019 August proposed rule as well as follow-up discussions held with stakeholders during May 2020 to August 2020. EPA is specifically soliciting comments on the validity and suitability of the use of all new information, data, and potential analyses being noticed today. Moreover, through this Notice the Agency will accept additional data and information that the public has that may help inform the reconsideration of the beneficial use definition and provisions for accumulations of CCR destined for beneficial use or disposal. The Agency is only requesting comment on the two issues and information specifically identified in this Notice or located in the docket for this Notice and is not reopening any other aspect of the proposal or the underlying support documents that were previously available for comment.
