Marilyn Tavenner Acting Administrator Centers for Medicare & Medicaid Services Dear Ms. Tavenner: The North Carolina Chapter of the AAP comments favorably on the proposed rule CMS-2370-P. We strongly support the proposed rule implementing Section 1202 of the Affordable Care Act (ACA). Medicaid is indispensable to children and adolescents in NC as well as to pediatricians. Over 960,800 children in our state depend on Medicaid which currently pays about 9 percent below Medicare rates for comparable services in NC. The two year Medicaid primary care payment increase is a vital step to enhance access to care for NC children who will be covered by Medicaid in 2013-14. We also express our support for including pediatric subspecialists as physicians eligible to receive the payment increase. Pediatric subspecialists play a vital role in the provision of primary care services for children. Community Care of North Carolina is promoting co-management strategies so that subspecialty and primary care pediatricians work together to improve patient outcomes. We urge CMS to clarify in the final rule that any pediatric subspecialty, regardless of the board providing certification, should be deemed eligible for enhanced Medicaid payment for primary care services. We support the requirement that the Medicaid payment increase apply to all primary care services outlined in statute, including those not recognized for payment by Medicare. Primary care services utilized by children in Medicaid, as noted in the proposed rule, are often not recognized for payment by Medicare even when values are published in the Medicare Physician Fee Schedule. Applying the payment increase to all primary care will help ensure that the payment increase equitably benefits the pediatric population. Abstract

This proposed rule would implement new requirements in sections 1902(a)(13), 1902(jj), 1932(f), and 1905(dd) of the Social Security Act, as amended by the Patient Protection and Affordable Care Act of 2010 (the Affordable Care Act). It implements Medicaid payment for primary care services furnished by certain physicians in calendar years (CYs) 2013 and 2014 at rates not less than the Medicare rates in effect in those CYs or, if greater, the payment rates that would be applicable in those CYs using the CY 2009 Medicare physician fee schedule conversion factor (CF). This minimum payment level applies to specified primary care services furnished by a physician with a specialty designation of family medicine, general internal medicine, or pediatric medicine, and also applies to services paid through Medicaid managed care plans. It would also provide for a 100 percent Federal matching rate for any increase in payment above the amounts that would be due for these services under the provisions of the State plan as of July 1, 2009. In this proposed rule, we specify which services and types of physicians qualify for the minimum payment level in CYs 2013 and 2014, and the method for calculating the payment amount and any increase for which increased Federal funding is due. In addition, this proposed rule would update the interim regional maximum fees that providers may charge for the administration of pediatric vaccines to federally vaccine-eligible children under the Pediatric Immunization Distribution Program, more commonly known as the Vaccines for Children (VFC) program.
