On behalf of the American Academy of Pediatrics (AAP), a non-profit professional organization of 67,000 primary care pediatricians, pediatric medical subspecialists, and pediatric surgical specialists dedicated to the health, safety and well-being of infants, children, adolescents, and young adults, we submit the attached comments regarding proposed changes to the Medicaid and Childrens Health Insurance Plan (CHIP) managed care regulatory framework. The Academy is deeply concerned with the proposed changes the rule makes to network adequacy standards and disseminating information to enrollees. When considered in conjunction with the Departments proposed rule to roll back the Medicaid Access Rule, these changes could leave children, particularly those with serious, chronic, or complex medical needs, with reduced access to the care they need. We urge CMS to reconsider these provisions before issuing a final rule.

Abstract

This proposed rule advances CMS’ efforts to streamline the Medicaid and Children’s Health Insurance Plan (CHIP) managed care regulatory framework and reflects a broader strategy to relieve regulatory burdens; support state flexibility and local leadership; and promote transparency, flexibility, and innovation in the delivery of care. These proposed revisions of the Medicaid and CHIP managed care regulations are intended to ensure that the regulatory framework is efficient and feasible for states to implement in a cost-effective manner and ensure that states can implement and operate Medicaid and CHIP managed care programs without undue administrative burdens.
