As advocates for child and adolescent health, the undersigned organizations appreciate the opportunity to comment on the proposed rule, Affordability of Employer Coverage for Family Members of Employees, issued by the Internal Revenue Service (IRS). We write in strong support of the proposed rule, which would correct the "family glitch" that was created by a 2013 misinterpretation of the Affordable Care Act (ACA). The full comment letter on behalf of 68 child health organizations is attached.

Abstract

This document contains proposed regulations under section 36B of the Internal Revenue Code (the ‘‘Code’’) that would amend the existing regulations regarding eligibility for the premium tax credit (‘‘PTC’’) to provide that affordability of employer-sponsored minimum essential coverage (employer coverage) for family members of an employee is determined based on the employee’s share of the cost of covering the employee and those family members, not the cost of covering only the employee.
