Abstract

Investment advice fiduciaries must avoid conflicts of interest when making transactions involving retirement plans and accounts unless they comply with a prohibited transaction exemption. In connection with its proposal to update its regulation defining a “fiduciary,” the Department of Labor is proposing to update PTE-2020-02 to provide additional protections for plans and investors and offer additional clarity for investment advice fiduciaries who want to receive compensation for their advice or engage in transactions that would otherwise violate federal law.
