On behalf of the American Bus Association (ABA), please find attached our comments regarding FMCSA's proposed rule on English Language Proficiency Out-of-Service Criteria, Docket No. FMCSA-2026-0826. ABA represents the private motorcoach and group travel industry, whose members transport millions of passengers each year across the United States. Our comments support the underlying English language proficiency safety requirement while urging FMCSA to ensure that the assessment and enforcement process is clear, objective, and consistently applied, and to more fully consider the rule's operational and economic impacts on passenger motor carriers. Thank you for your consideration of ABA's comments.

Abstract

FMCSA proposes to codify the English language proficiency (ELP) driver qualification requirement as an out-of-service (OOS) violation. The rulemaking would ensure uniform enforcement by aligning the Federal Motor Carrier Safety Regulations (FMCSRs) with the current enforcement tolerances in the North American Standard Out-of-Service Criteria. The rulemaking responds to a petition from the Commercial Vehicle Safety Alliance (CVSA).
