Dear Sir/Madam: The Methyl Bromide Industry Panel (Panel) of the American Chemistry Council submits these comments regarding the U.S. Environmental Protection Agency's (EPA) November 28, 2008, Federal Register notice on the EPA's proposed rulemaking to implement 2009 Critical Use exemption From the Phaseout of Methyl Bromide. The Panel consists of companies that hold technical and end- use registrations for methyl bromide products under the Federal Insecticide Fungicide and Rodenticide Act (FIFRA). The Panel appreciates the opportunity to submit the comments in the attached files.

Abstract
EPA is proposing an exemption to the phaseout of methyl bromide to meet the needs of 2009 critical uses. Specifically, EPA is authorizing uses that will qualify for the 2009 critical use exemption (CUE) and the amount of methyl bromide that may be produced, imported, or supplied from inventory for those uses in 2009. EPA takes this action under the authority of the Clean Air Act to reflect recent consensus decisions taken by the Parties to the Montreal Protocol on Substances that Deplete the Ozone Layer at the 19th Meeting of the Parties.
