The American Chemistry Council (ACC) appreciates the opportunity to provide written recommendations to the U.S. EPA and the Army Corps of Engineers in response to their request for recommendations as they revise the definition of the "waters of the United States" under the Clean Water Act. ACC member companies own and operate facilities located on or near "waters of the United States" or waters that may be classified as such pursuant to the criteria provided in the agencies' new rulemaking. Many ACC members have water management features on-site, including ditches, fire water ponds, cooling ponds, and stormwater basins, and could be impacted by proposed revisions to the definition of "waters of the U.S." As such, ACC offers these brief recommendations for the agencies' consideration. These comments are submitted with ACC's 2014 comments on the proposed "Clean Water Rule" for reference. The 2014 comments also contained additional recommendations that would be relevant to the agencies' effort to revise the definition of "waters of the U.S."

Abstract

In accordance with a Presidential directive, the U.S. Environmental Protection Agency (EPA) and the Department of the Army (Army) are developing a new definition for “waters of the United States.” This docket will be associated with a non-regulatory preproposal notice announcing a series of public webinars and soliciting feedback from the public.
