ACC appreciates the opportunity to submit comments in response to EPA's request for comment on its "Clean Water Act Coverage of 'Discharges of Pollutants' via a Direct Hydrologic Connection to Surface Water." ACC members own and operate a number of facilities nationwide that are subject to regulatory requirements at the federal, state, and local levels, including the Clean Water Act (CWA) National Pollutant Discharge Elimination System (NPDES) program. ACC member facilities must routinely demonstrate compliance with these requirements for facility discharges or outfalls as well as ensure that any new or expanded facility activities are appropriately permitted. As such, ACC members have an important interest in the proper application and administration of permit programs such as CWA NPDES.

Abstract

EPA is requesting comment on the Agency’s previous statements regarding the Clean Water Act that pollutant discharges from point sources that reach jurisdictional surface waters via groundwater or other subsurface flow that has a direct hydrologic connection to the jurisdictional surface water may be subject to CWA regulation.
