The American Coatings Association (ACA) submits the attached comments regarding the U.S. Environmental Protection Agencys (EPA) proposed rule to reconsider the 2017 Risk Management Program (RMP) Final Rule Amendments. The proposal includes several changes to the accident prevention program requirements that will have an impact on ACAs member companies who have RMP-regulated facilities.Thank you for your consideration of our comments and concerns. The American Coatings Association (ACA) hereby submits the attached comments regarding the U.S. Environmental Protection Agency's (EPA) proposed further delay of the effective date of the final rule that amends the Risk Management Program (RMP) regulations under the Clean Air Act. ACA has several member companies that have facilities that are impacted by the RMP regulations and requirements, so we appreciate the opportunity to comment on and express our support for this proposed delay. ACA is a voluntary, nonprofit trade association working to advance the needs of the paint and coatings industry and the professionals who work in it. The organization represents paint and coatings manufacturers, raw materials suppliers, distributors, and technical professionals. ACA serves as an advocate and ally for members on legislative, regulatory, and judicial issues, and provides forums for the advancement and promotion of the industry through educational and professional development services.

Abstract

EPA is proposing several changes to the final Risk Management Program Amendments rule (Amendments rule) issued on January 13, 2017, whose effective date has been delayed until February 19, 2019. EPA is proposing to rescind amendments relating to safer technology and alternatives analyses, third-party audits, incident investigations, information availability, and several other minor regulatory changes and to modify amendments relating to local emergency coordination and emergency exercises, along with their compliance dates.
