Abstract
To promote families having children, these proposed rules would amend the Departments’ regulations for group health plans regarding excepted benefits by adding excepted fertility benefits as a new category of limited excepted benefits that employers may offer to workers. Excepted benefits do not have to meet certain requirements of the Affordable Care Act and other laws, and limited excepted benefits are a category of excepted benefits that meet specific criteria. The excepted fertility benefit under these proposed rules could cover in vitro fertilization and other fertility-related medical care.
