As described in the attached comment letter, API remains concerned and frustrated that the EPA is not proposing reasonable steps to ease the burden of unreasonable regulations on industry. We applaud the few limited steps the agency plans to take to curb unnecessary regulations on American businesses, but this administration needs to go much further if it is serious about getting the economy back on track. We do not believe that EPA has met the spirit or the intent of the President's Executive Order to address the breadth of outmoded, ineffective, insufficient or excessively burdensome regulations.
The American Petroleum Institute ("API") appreciates the opportunity to submit these comments to the Improving Regulations Docket of the U.S. Environmental Protection Agency's ("EPA") in response to the notice found at 76 Federal Register 14840 (Friday, March 18, 2011). API is a nationwide, non-profit, trade association headquartered in Washington, D.C. that represents over 450 members of all sizes engaged in all aspects of the petroleum and natural gas industry, including exploration, production, refining, and distribution of petroleum products. As called for by President Obama in Executive Order 13563, "to facilitate the periodic review of existing significant regulations," EPA will "consider how best to promote retrospective analysis of rules that may be outmoded, ineffective, insufficient, or excessively burdensome, and to modify, streamline, expand, or repeal them in accordance with what has been learned." API supports the attached joint association comments on the review of regulations and the general and specific comments listed also attached. The items contained herein are not prioritized. API looks forward to working with EPA as this process and the specific reviews are undertaken. Please contact me if you have any questions.
Abstract
This docket contains general public suggestions regarding the design of EPA's plan to periodically review its regulations. This docket should be used when the commenter is not sure what other category to choose, or if the comment spans multiple categories. Also, use this docket to provide other general comments on the factors EPA should consider in conducting its review, the process EPA will use in setting priorities, or the identification of candidate rules for review.
