Referenced within the letter as Attachment A and Attachment B and included as separate attachments to this comment are [Attachment A] the American Petroleum Institute's comments on NSPS OOOOb & EG OOOOc (2021 Proposal and 2022 Supplemental Proposal), and [Attachment B] the Industry Trades' comments on EPA's proposed revisions to Subpart W.

Abstract

Proposed rulemaking to meet directives set forth in section 136 with respect to the Methane Emissions and Waste Reduction Incentive Program. Section 60113 of the Inflation Reduction Act of 2022 amended the Clean Air Act (CAA) by adding section 136, “Methane Emissions and Waste Reduction Incentive Program for Petroleum and Natural Gas Systems.” CAA section 136(c) directs the Administrator of the EPA to impose and collect a “Waste Emissions Charge” on methane emissions that exceed statutorily specified waste emissions thresholds from an owner or operator of an applicable facility.
