API submits herewith a paper entitled, Available Manufacturing Uses Of Spent Hydrotreating And Hydrorefining Catalysts From The Petroleum Refining Industry: HOW 40 C.F.R. PART 261 COULD BE AMENDED TO PROMOTE CONSISTENTLY HIGH RATES OF RESOURCE CONSERVATION AND RECOVERY. The paper contains a detailed proposal for a conditional exclusion from the definition of hazardous waste for catalysts that are recycled (including proposed regulatory language). It also contains new analysis of existing data on the decline in recycling rates following the 1998 listings, and more recent data on recycling rates. In addition to the report there are 15 attachments (A - O) which have each been added to the docket.
