The American Pharmacists Association ("APhA") appreciates the opportunity to submit comments to the Employee Benefits Security Administration ("EBSA"), the Department of the Treasury, the Internal Revenue Service ("IRS'), and the Department of Health and Human Services ("HHS") (the "Departments") on the proposed rules titled "Enhancing Coverage of Preventive Services Under the Affordable Care Act," including the expansion of coverage of over-the-counter (OTC) contraception without cost sharing, beginning on or after January 1, 2026, and the role pharmacists and pharmacies have in ensuring patients have greater access to contraception. APhA is the only organization advancing the entire pharmacy profession. APhA represents pharmacists, student pharmacists, and pharmacy technicians in all practice settings, including but not limited to community pharmacies, hospitals, long-term care facilities, specialty pharmacies, community health centers, physician offices, ambulatory clinics, managed care organizations, hospice settings, and government facilities. Our members strive to improve medication use, advance patient care, and enhance public health. Please, see attached PDF for full comments. Abstract

This document proposes to amend regulations under the Affordable Care Act regarding coverage of preventive services by group health plans and health insurance issuers offering group or individual health insurance coverage. The rules propose new requirements regarding the use of medical management techniques with respect to such services, as well as new requirements regarding coverage of over the-counter contraceptives and contraceptives that are drugs and drug-led combination products. These rules also propose to require a disclosure regarding contraceptive coverage through the Transparency in Coverage internet-based self-service tool. These proposed rules would not modify Federal conscience protections related to contraceptive coverage.
