Dear Secretary Tabor, The American Pharmacists Association (APhA) appreciates the opportunity to provide FTC comments on the "Caremark and Zinc Health Services; Analysis of Proposed Agreement Containing Consent Order To Aid Public Comment," request for comment. APhA represents pharmacists, student pharmacists, and pharmacy technicians in all practice settings, including but not limited to community pharmacies, hospitals, long-term care facilities, specialty pharmacies, community health centers, physician offices, ambulatory clinics, managed care organizations, hospice settings, and government facilities. Abstract
The consent agreement in this matter settles alleged violations of Federal law prohibiting unfair methods of competition. The attached Analysis of Proposed Agreement Containing Consent Orders to Aid Public Comment describes both the allegations in the complaint and the terms of the consent order—embodied in the consent agreement—that would settle these allegations.
