The American Public Power Association (APPA or Association) respectfully submits the following comments on EPAs Response to Clean Air Act Section 126(b) Petition from New York; Notice of Proposed Action on Petition (Proposed Action). For the reasons described in the Proposed Action, and as discussed herein, Association supports EPAs proposal to deny the petition filed by New York under section 126 of the Clean Air Act (CAA or Act). EPA should make final its proposed denial of the petition.

Abstract

This action responds to a CAA section 126(b) petition dated March 12, 2018, by the State of New York. The petition requests that EPA make a finding that emissions from the collection of identified sources in nine states (Illinois, Indiana, Kentucky, Maryland, Michigan, Ohio, Pennsylvania, Virginia and West Virginia) significantly contribute to and interfere with maintenance of the 2008 and 2015 ozone national ambient air quality standards (NAAQS) in New York in violation of the good neighbor provision under the CAA.
