The American Public Power Association (APPA or Association) appreciates the opportunity to provide comments on the Environmental Protection Agency's (EPA or Agency) proposed rule entitled, "Adoption and Submittal of State Plans for Designated Facilities: Implementing Regulations Under Clean Air Act Section 111(d)" (the Proposed Rule)
40 CFR Part 60 Subpart Ba: Adoption and Submittal of State Plans for Designated Facilities provides general requirements for regulations under Clean Air Act section 111(d). These requirements address the EPA’s promulgation of emission guidelines for existing sources under Clean Air Act section 111(d), as well as state and federal plans implementing those emission guidelines. These requirements include the process through which states submit plans to the EPA and the processes through which the EPA acts on the submissions.
