The American Public Power Association (APPA or Association) appreciates the opportunity to submit comments in response to the U.S. Environmental Protection Agency's (EPA or Agency) advanced notice of proposed rulemaking (ANPRM), "Visibility Protection: Regional Haze State Plan Requirements Rule Revision", which seeks stakeholder input on the restructuring of the Regional Haze Rule (RHR) to streamline regulatory requirement impacting states' viability obligations under the Clean Air Act See attached file(s)

Abstract

Consistent with the EPA Administrator’s regulatory agenda announcement in March 2025, the EPA intends to restructure the Regional Haze Program Rule (40 CFR Part 51 Subpart P). This rulemaking effort is expected to focus on future regional haze planning obligations for states. The rule restructuring effort will ensure that it fulfills Congressional intent, is based on current scientific and technical information, and reflects recent improvements in air quality. As a first step, the EPA intends to issue an advance notice of proposed rulemaking to solicit ideas and potential approaches to include in a forthcoming notice of proposed rulemaking.
