The American Public Power Association submits comments on the Coal Combustion Residuals (CCR) State Permit Program Guidance Document (Interim Final) (82 Fed. Reg. 38,685 (August 15, 2017)) Docket ID No. EPA-HQ-OLEM-2017-0458

Abstract

The EPA is soliciting public comment on an interim final guidance document addressing specific questions and the procedures on which Coal Combustion Residuals (CCR) State Permit Programs will be reviewed for approval by the Agency as a result of the Water Infrastructure Improvements for the Nation (WIIN) Act signed by the President on December 16, 2016. This guidance document includes two sets of frequently asked questions and two checklists. The first set of questions are on the WIIN Act and the second set are related to the process for seeking EPA approval of State CCR permit program. The first checklist contains the requirements of 40 CFR part 257, subpart D, and the second checklist shows the materials EPA believes would constitute a “complete” CCR permit program application.
