The Honorable Brenda Mallory, Chair Council on Environmental Quality 730 Jackson Place NW Washington, DC 20503 Re: Comments on Notice of Proposed Rulemaking, Revisions to the Regulations Implementing the National Environmental Policy Act, Docket Number CEQ–2021–0002 Dear Chair Mallory: On behalf of the Animal Welfare Institute ("AWI"), we submit the following comments on the Council on Environmental Quality's ("CEQ") proposed rulemaking to revise the regulations issued on July 16, 2020, implementing the National Environmental Policy Act ("2020 regulations"), 42 U.S.C. §§ 4321, et seq., 85 Fed. Reg. 43,304 (July 16, 2020). See 86 Fed. Reg. 55,757 (Oct. 7, 2021). In order to restore clarity and confidence in the NEPA process, we encourage CEQ to rescind the 2020 regulations and reinstate the 1978 regulations in the first phase of rulemaking, and use the second phase of rulemaking to initiate improvements to the NEPA process. We also encourage CEQ to adopt the necessary changes to the alternatives analysis proposed in the attached document, and we fully support the proposal to reinstate the CEA.
