Dear Secretary Haaland and Secretary Raimondo: The Animal Welfare Institute ("AWI") submits the following comments in support of the proposal of the U.S. Fish and Wildlife Service ("USFWS") and the National Marine Fisheries Service ("NMFS") (collectively the "Services") to rescind the final rule titled "Regulations for Listing Endangered and Threatened Species and Designating Critical Habitat" that was published on December 16, 2020, and became effective on January 15, 2021 ("Final Habitat Rule"). 86 Fed. Reg. 59,353 (Oct. 27, 2021). The definition of "habitat" established in the Final Habitat Rule is unduly narrow because it excludes habitat that is degraded but able to be suitably restored, as well as areas that are likely to become habitat in the foreseeable future as species' ranges shift due to climate change and habitat destruction. As such, the definition leaves areas that are essential to species' recovery unprotected, which places listed species in peril. AWI therefore supports the Services' proposed regulation to rescind the Final Habitat Rule. Please see the attached document for a complete analysis of our concerns with the Final Habitat Rule.
