The Center for Biological Diversity submits the attached comments on the proposed rule for the emperor penguin (Aptenodytes forsteri) under the U.S. Endangered Species Act. We strongly support listing the emperor penguin as a threatened species, which is fully supported by the best-available science including the recent study by Jenouvrier et al. (2021), and we urge you to promptly finalize this listing. The listing will provide important benefits to emperor penguins, particularly if the U.S. Fish and Wildlife Service implements the full protections afforded by the ESA. We are also providing the pdfs of the cited references.

Abstract

We, the U.S. Fish and Wildlife Service (Service), propose to list the emperor penguin (Aptenodytes fosteri), a flightless bird species from Antarctica as a threatened species under the Endangered Species Act of 1973, as amended (Act). This proposal also serves as our 12-month finding on a petition to list the emperor penguin. After a review of the best available scientific and commercial information, we find that listing the species is warranted. Accordingly, we propose to list the emperor penguin as a threatened species with a rule issued under section 4(d) of the Act (4(d) rule). If we finalize this rule as proposed, it would add this species to the List of Endangered and Threatened Wildlife and extend the Act’s protections to the species.
