Defenders of Wildlife and Patagonia Area Resource Alliance submit the attached comment letter and attached Exhibits A-F in response to the proposed "Definition of 'Waters of the United States' Under the Clean Water Act," and request for public comment. 79 Fed. Reg. 22188 (April 21, 2014). Thank you for your consideration of these comments.

Abstract

The U.S. Army Corps of Engineers (Corps) and the Environmental Protection Agency (EPA) are publishing for public comment a proposed rule defining the scope of waters protected under the Clean Water Act (CWA), in light of the U.S. Supreme Court cases in U.S. v. Riverside Bayview, Rapanos v. United States, and Solid Waste Agency v. U.S. Army Corps of Engineers (SWANCC).
