The Edison Electric Institute (EEI) appreciates the opportunity to provide the enclosed responses to the U.S. Environmental Protection Agency's (EPA) proposed rule regarding Adoption and Submittal of State Plans for Designated Facilities: Implementing Regulations Under Clean Air Act Section 111(d). 87 Fed. Reg. 79,176 (Dec. 23, 2022). As EPA moves forward with regulations under Clean Air Act section 111 to address carbon dioxide emissions from fossil-based electric generating units, updating the implementing regulations to provide states and electric companies with additional flexibility and time is both timely and well founded. EEI is the association that represents all U.S. investor-owned electric companies. Our members provide electricity for about 220 million Americans and operate in all 50 states and the District of Columbia. As a whole, the electric power industry supports more than 7 million jobs in communities across the United States. EEI's member companies are proud to provide America's resilient clean energy and to be leading the transformation of energy.

Abstract

40 CFR Part 60 Subpart Ba: Adoption and Submittal of State Plans for Designated Facilities provides general requirements for regulations under Clean Air Act section 111(d). These requirements address the EPA’s promulgation of emission guidelines for existing sources under Clean Air Act section 111(d), as well as state and federal plans implementing those emission guidelines. These requirements include the process through which states submit plans to the EPA and the processes through which the EPA acts on the submissions.
