The Edison Electric Institute (EEI) appreciates this opportunity to comment on the U.S. Environmental Protection Agency's (EPA or Agency) proposed Effluent Limitations Guidelines and Standards for the Steam Electric Power Generating Point Source Category, which would revise the final 2015 effluent limitations guidelines (ELGs) for both flue gas desulfurization (FGD) wastewater and bottom ash transport water (BATW) under the Clean Water Act (CWA). 84 Fed. Reg. 64,620 (Nov. 22, 2019) (Proposed Rule or Proposed ELG Rule). The Proposed Rule addresses technical and economic considerations related to FGD wastewater and BATW by including limited and necessary changes to the 2015 ELGs that meet the stringent requirements of the CWA, while providing the flexibility that EEI's members need to invest in treatment technologies that that will efficiently and reliably reduce pollutants in a cost-effective manner. EEI is the association that represents all U.S. investor-owned electric companies. Our members provide electricity for about 220 million Americans and operate in all 50 states and the District of Columbia. As a whole, the electric power industry supports more than seven million jobs in communities across the United States. EEI member companies invest more than $100 billion dollars annually to make the energy grid smarter, cleaner, more dynamic, more flexible, and more secure in order to provide affordable and reliable electricity to customers, with over $130 billion invested in 2019 alone. EEI's comments suggest several additional clarifications and modifications that should be included in the final rule to provide additional regulatory certainty and aid companies as they comply with the requirements. Specifically, EPA should: Finalize the revised best available technology (BAT) limits for BATW while including essential compliance flexibilities like rolling average provisions, blowdown allowances and an allowance for additional discharges where necessary to account for large scale natural disasters that overwhelm current BATW systems because of heavy and prolonged precipitation. EPA also should allow permit writers to extend the applicability dates for BATW compliance beyond December 31, 2023; Move forward with both the technology basis and compliance dates proposed for FGD wastewater, but consider adjusting those limitations, as EPA's proposed limits do not reflect the wide variety of unit operations and variable circumstances that impact unit performance; Finalize the proposed subcategory for retiring boilers since it is consistent with both past agency action and judicial precedent and will result in overall reduced pollutant discharges. EPA should clarify that this subcategory also applies to units that are repowering (with non-coal fuel sources) by December 31, 2028. EPA also should further develop the proposed subcategory for low-utilization units; Establish voluntary incentive program limits as proposed for FGD wastewater using membrane filtration as the technology basis for these limits, as well as the compliance deadline of December 31, 2028; and, Finalize EPA's proposed reliance on water-quality-based effluent limits (WQBELs) in lieu of nationally applicable BAT limits to address any potential impacts of bromides is appropriate and should be finalized. Should EPA determine that additional action with respect to bromides may be warranted at a national level, it is incumbent on EPA to address the issue meaningfully and comprehensivelyas opposed to in a piecemeal fashion ELG by ELG. EEI appreciates the opportunity to comment on the Proposed ELG Rule, and EPA should move expeditiously to finalize the proposed updates to the 2015 rule so state and local regulators, as well as EEI's members, can adequately plan for the National Pollutant Discharge Elimination System (NPDES) permit modifications that will be necessary to meet all technology-based requirements applicable to the industry. Abstract

EPA announced on September 15, 2009 the start of a rulemaking process to revise the effluent limitations guidelines and standards for the steam electric power generating point source category (i.e., steam electric power plants). EPA’s decision to proceed with a rulemaking was made upon reviewing the findings from a multi-year study of wastewater discharges from power plants.EPA’s review of wastewater discharges from power plants, and the treatment technologies available to reduce pollutant discharges, has demonstrated the need to update the current national effluent guidelines regulations. The current regulations, which were last updated in 1982, do not adequately address the pollutants being discharged and have not kept pace with changes that have occurred in the electric power industry over the last three decades.
