The Edison Electric Institute (EEI) appreciates the opportunity to submit these comments on the U.S. Environmental Protection Agency's (EPA) and U.S. Army Corps of Engineers' (Corps) Federal Register notice seeking input from stakeholders and the public on how to revise the definition of "waters of the United States" (WOTUS) under the Clean Water Act (CWA). 82 Fed. Reg. 40,742 (Aug. 28, 2017).

Abstract

In accordance with a Presidential directive, the U.S. Environmental Protection Agency (EPA) and the Department of the Army (Army) are developing a new definition for “waters of the United States.” This docket will be associated with a non-regulatory preproposal notice announcing a series of public webinars and soliciting feedback from the public.
