Dear Sir or Madam: The Edison Electric Institute (EEI) appreciates the opportunity to submit the attached comments in response to the April 2, 2010 Federal Register notice reagrding the "Proposed Determination to Prohibit, Restrict, or Deny the Specification, or the Use for Specification, of an Area as a Disposal Site; Spruce No. 1 Surface Mine, Logan County, WV 75 Fed. Reg. 16788 (April 2, 2010), Docket ID No. R03-OW-2009-0985." In that notice, the Environmental Protection Agency (EPA) is seeking comment on a proposal under Clean Water Act (CWA) Section 404(c) "to withdraw or restrict use of Seng Camp Creek, Pigeonroost Branch, Oldhouse Branch, and certain tributaries to those waters in Logan County, West Virginia to receive dredged and/or fill material in connection with construction of the Spruce No. 1 Surface Mine."
