The Edison Electric Institute (EEI) appreciates the opportunity to submit comments on the Occupational Safety and Health Administrations (OSHA or the Agency) Powered Industrial Trucks; Request for Information 84 Fed. Reg. 8,633 (March 11, 2019) (RFI). In considering what actions, if any, may be appropriate, EEI asks OSHA to consider compliance timing, flexibility and affordability in its decision-making. EEI and its members encourage OSHA to keep these important principles in mind when deciding whether and how to move forward in reducing regulatory burdens associated with the regulation of powered industrial trucks.
