In this proposed NPRM the FAA used two examples to set the basis for establishing the SMS program on all part 139 airports, the Pinacle Airlines Flight 3701 and the Cessna 310R aircraft accidents. These two aircraft accidents have absolutly nothing to do with on-airport, airside safety issues and are extremely poor examples of why part 139 airports must develop and implement SMS programs. EAA requests the FAA show at least two examples of on-airport, airside safety issues that clearly show the safety issues that a SMS program would correct. EAA also requests that these two (or more) examples be published in this Docket prior to the end of the public comment period. Randy Hansen EAA Government Relations Director
