EAA Requests the DHS/TSA letter "Applicability of 49 CFR part 1552 to certain types of aircraft", issued on October 29, 2009 be expanded to include gyroplanes, weight-shift-control (WSC), and powered parachutes (PPC). This DHS/TSA determination letter stated that "airships, balloons, and gliders pose a minimal threat to aviation and national security." and "In addition, learning to operate one of these types of aircraft would not provide a person with the skills needed to operate rotary or fixed-wing aircraft that are motorized and capable of carrying larger payloads and amounts of fuel." Finally, "Accordingly, TSA is granting an exemption from 49 CFR part 1552 to flight schools that provide, and individuals who apply for, instruction in the operation of airships, balloons, or gliders, as those terms are defined at 14 CFR 1.1." On August 7, 2007 EAA requested that gyroplanes, WSC, and PPC aircraft be added to the exemption as they have the same operating characterics and non- security issues as those aircraft operating under the current exemption. EAA is requesting that this request for exemption be renewed because as of this date (July 13, 2009) no action has been taken by TSA on the original request. Attached is letter I was telling you about. The Illinois Inspector in charge of this rule in Illinois, Terry Myers, has told us his superiors in Washington say this applies to any EXPERIMENTAL aircraft other than airplanes - in other words, gyroplanes, PPC, Trikes, balloons, etc. Terry actually vetted this issue, especially with gyroplanes, with his superiors before appearing on Roy Beiswinger's Ultraflight Radio show and stating this very directly. This has obvious benefits to not be restricted from providing training to non US citizens for these such aircraft. But, we would prefer to see this in writing specifically - before giving that guidance to our experimental gyroplane instructors. Any advice or information you can provide will be much appreciate…
