Please replace comments submitted under Comment Tracking Number: 1k1-8yv6-rd1o (Submitted on September 25, 2017) with the following comments: The Fertilizer Institute (TFI), on behalf of its member companies, submits these comments addressing the U.S. Environmental Protection Agency's (EPA) and the U.S. Army Corps of Engineers (ACOE) (together, the "Agencies") proposed rule entitled "Definition of Waters of the United States - Recodification of Pre-Existing Rules". The proposed rule, published in the Federal Register on July 27, 2017, appears at 82 Fed. Reg. 34,899. TFI represents the nation's fertilizer industry, including producers, importers, retailers, wholesalers and companies that are engaged in all aspects of the fertilizer supply chain. Fertilizer is a key ingredient in feeding a growing global population, which is expected to surpass 9.5 billion people by 2050. Half of all food grown around the world today is made possible through the use of fertilizer. Many of TFI's members and their customers are subject to requirements under the Clean Water Act upon which the Agencies are seeking comment in the proposed rule. As such, TFI has a significant interest in the proposed rule and offers the attached comments.

Abstract

As a first step in addressing a Presidential directive, the U.S. Environmental Protection Agency (EPA) and the Department of the Army (Army) plan to recodify the previous definition of “waters of the United States.”
