The Fertilizer Institute (TFI), on behalf of its member companies, submits these comments addressing the U.S. Environmental Protection Agency's (EPA) and the U.S. Army Corps of Engineers (ACOE) (together, the "Agencies") proposed rule entitled "Definition of "Waters of the United States"Addition of an Applicability Date to 2015 Clean Water Rule". The proposed rule, published in the Federal Register on November 22, 2017, appears at 82 Fed. Reg. 55,542. TFI represents the nation's fertilizer industry, including producers, importers, retailers, wholesalers and companies that are engaged in all aspects of the fertilizer supply chain. Fertilizer is a key ingredient in feeding a growing global population, which is expected to surpass 9.5 billion people by 2050. Half of all food grown around the world today is made possible through the use of fertilizer. Many of TFI's members and their customers are subject to requirements under the Clean Water Act upon which the Agencies are seeking comment in the proposed rule. As such, TFI has a significant interest in the proposed rule and offers the attached comments.

Abstract

The U.S. Environmental Protection Agency (EPA) and the Department of the Army (Army) are proposing to add an applicability date to the 2015 Clean Water Rule.
