The Aerospace Industries Association (AIA) and General Aviation Manufacturers Association (GAMA) represent manufacturers of commercial and general aviation aircraft, engines, avionics and components who provide products and airworthiness and maintenance services to nearly every commercial and general aviation operator in the U.S. and throughout the world. AIA/GAMA appreciates the opportunity to review Notice of Proposed Rulemaking (NPRM) 10-15, Safety Management Systems [SMS] for Part 121 Certificate Holders published in the Federal Register on November 5, 2011 (75FR68224). FAA clearly states that "Although this proposal extends only to part 121 operators, the FAA has developed these general requirements with the intent that in the future, they could be applied to other FAA-regulated entities, such as part 135 operators, part 145 repair stations, and part 21 aircraft design and manufacturing organizations and approval holders (75FR68232)." This proposal and the new part 5 will serve as the foundation for SMS requirements across the broad industry for the foreseeable future so it is extremely important that it's initial establishment take due consideration of its intended application across the broader industry. On behalf of our member companies and the aviation manufacturing industry sector, AIA/GAMA offer the attached comments and recommendations for consideration by FAA to the proposal to establish a general framework for SMS regulatory requirements in the form of a new Federal Aviation Regulation (FAR) part 5. The first half provides general comments which include discussion on significant issues that we believe are key to the successful implementation of SMS as a regulatory requirement. The second half provides section-by-section comments and recommendations to the proposed part 5 rule language.
