Pursuant to section 307(d)(7)(B) of the Clean Air Act (CAA),1 the Interstate Natural Gas Association of America (INGAA), a trade association of the interstate natural gas pipeline industry, petitions you to reconsider the referenced final rule (Final Rule) and, pending reconsideration, to stay the application of the Final Rule to glycol dehydrators currently complying with part 63, subpart HHH of EPA's regulations through the 1 ton per year (1 tpy) benzene "alternative compliance option." INGAA respectfully requests immediate action. The Final Rule takes effect October 15, 2012. If the Final Rule is not reconsidered, or at least stayed pending reconsideration, glycol dehydrators that have been in compliance with subpart HHH since its inception will be exposed to costly and unwarranted additional requirements solely as the result of an apparent inadvertence. Equally important, INGAA members operating these dehydrators will not be able to comply with these new, misplaced requirements within the few weeks left before the Final Rule takes effect.
