Abstract

Clean Water Act (CWA) Section 404 requires permits for discharges of dredged or fill material to federally protected waters – including wetlands, lakes and streams – known as waters of the United States. The state of Michigan assumed administration of this program for inland waters and wetlands in 1984, while the U.S. Environmental Protection Agency (U.S. EPA) maintains oversight authority. The U.S. EPA is taking comments and hosting a public hearing on the proposed revisions to Michigan’s CWA Section 404 program resulting from Public Act 98, signed by Governor Snyder on July 2, 2013. The proposed revisions include corrections of deficiencies in Michigan’s Section 404 program previously identified by EPA in a 2008 review, a new definition narrowing the scope of contiguous wetlands regulated by the state, the addition of agricultural and other exemptions from permitting and changes to the requirements for mitigating the effects of filling wetlands.
