On behalf of the League of Women Voters of New Mexico, I urge you to permit families to remain together while their unlawful presence waiver is being adjudicated. This is good policy. We applaud DHS for recognizing that the three and ten bars are creating terrible hardships for U.S. Citizens and their families as they navigate through the legal permanent resident process. Many immigrants living honest, admirable lives in New Mexico who would qualify for waivers simply cannot apply because of the practical risks, costs,and hardships involved. We urge the Department to adopt this proposal along with the following improvements: 1) Expand regulation to cover all visa-eligible families separated by the bars, not just U.S Citizen children and spouses 2) Ensure that applications remain confidential and not trigger removal proceedings. Thank you.
