Please see the attached file with comments from the National Association of Chain Drug Stores in response to the Proposed Rule for Enhancing Coverage of Preventive Services Under the Affordable Care Act to include coverage for over-the-counter (OTC) contraceptive items. We appreciate the the Department of the Treasury, the Department of Labor, and the Department of Health and Human Services considering our comments and recommendations on this issue.

Abstract

This document proposes to amend regulations under the Affordable Care Act regarding coverage of preventive services by group health plans and health insurance issuers offering group or individual health insurance coverage. The rules propose new requirements regarding the use of medical management techniques with respect to such services, as well as new requirements regarding coverage of over the-counter contraceptives and contraceptives that are drugs and drug-led combination products. These rules also propose to require a disclosure regarding contraceptive coverage through the Transparency in Coverage internet-based self-service tool. These proposed rules would not modify Federal conscience protections related to contraceptive coverage.
