SEE ATTACHED COMMENT LETTER. On behalf of the more than 140,000 members of the National Association of Home Builders of the United States (NAHB), we submit these comments on the Occupational Safety and Health Administration's (OSHA) proposed rule and request for Comments on the Arizona State Plan for Occupational Safety and Health and the Agency's Proposed Reconsideration and Revocation that was published in the Federal Register on April 21, 2022 [87 Fed. Reg. 23,783]. Because NAHB members are constructing homes in Arizona, as well as in all twenty-two states that administer their own comprehensive occupational safety and health plans (State Plans), NAHB is an interested party in this matter and therefore, would like to provide its views on the proposal to revoke its affirmative determination granting final approval to the Arizona State Plan and whether their State Plan operations are at least as effective as Federal OSHA. NAHB is a Washington, D.C.-based trade association that represents more than 140,000 members who are involved in home building, remodeling, multifamily construction, property management, subcontracting, design, housing finance, building product manufacturing and other aspects of residential and light commercial construction. NAHB is affiliated with more than 700 state and local home builder associations around the country. NAHB's builder members construct about 80 percent of the new housing units, making housing a large engine of economic growth in the country. NAHB objects to OSHA's proposal to revoke its affirmative determination granting final approval to the State Plan and revert to initial approval and Federal authority to resume discretionary concurrent enforcement. This action is not supported by any demonstrable data or means to properly evaluate the effectiveness of the Arizona State Plan. Accordingly, OSHA's position, once again regarding the Arizona State Plan runs afoul of the congressional intent outlined in the Occupational Safety and Health Act. Additionally, OSHA's threat to rescind the final approval status of the Arizona State Plan will have a chilling effect on other State Plan states who wish to develop new or innovative solutions to occupational safety and health issues in their approved state plans. Therefore, NAHB urges OSHA to withdraw this proposed rule.
