Abstract

This docket is for rulemakings that will identify additional non-hazardous secondary materials (NHSMs) that are categorical non-wastes when combusted. The proposed NHSMs will be added to an existing list at 40 CFR 241.4(a) if finalized. The part 241 regulations were initially promulgated in the “Identification of Non-Hazardous Secondary Materials That Are Solid Waste” final rule (EPA–HQ–RCRA–2008–0329-1734). The regulations at 40 CFR 241.3 provide the standards and procedures for identifying whether NHSM are or are not solid waste when used as fuels or ingredients in combustion units.
