The National Association of Manufacturers (NAM) is pleased to provide these comments on the notice of proposed rulemaking, "Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales, and Computer Employees" (88 FR 62152) issued by the Department of Labor's (Department or DOL) Wage and Hour Division (WHD).

Abstract

The U.S. Department of Labor’s Wage and Hour Division proposes to update and revise the regulations implementing the exemption of certain white-collar employees from minimum wage and overtime pay under section 13(a)(1) of the Fair Labor Standards Act (FLSA). Specifically, the proposal includes (1) increasing the standard salary level generally required for exemption; (2) increasing the highly compensated employee total annual compensation amount; and (3) automatically updating the earnings thresholds every three years using current wage data. These changes would more effectively identify exempt white-collar employees.
