Please find attached comments on the Department of Homeland Security's advance notice of proposed rulemaking on the "Secure Handling of Ammonium Nitrate Program." 73 Fed. Reg. 64,280 (Oct. 29, 2008). These comments are submitted on behalf of the National Mining Association, Industrial Minerals Association – North America, National Lime Association, National Stone, Sand and Gravel Association, and Portland Cement Association.

Abstract

This Advance Notice of Proposed Rulemaking seeks comment on the recent amendment to the Homeland Security Act entitled the Secure Handling of Ammonium Nitrate. The amendment requires the Department of Homeland Security to “regulate the sale and transfer of ammonium nitrate by an ammonium nitrate facility…to prevent the misappropriation or use of ammonium nitrate in an act of terrorism.”
