The National Mining Association appreciates the opportunity to submit comments on the U.S. Environmental Protection Agency's Advanced Notice of Proposed Rulemaking requesting feedback on "Hazardous and Solid Waste Management System: Disposal of Coal Combustion Residuals From Electric Utilities; Federal CCR Permit Program; General Permit Provisions," 91 Fed. Reg. 43,051 (July 14, 2026), Docket ID No. EPA-HQ-OLEM-2026-4159.

Abstract

The Environmental Protection Agency (EPA) issued a proposed rule on February 20, 2020, to establish a Federal permit program for disposal of coal combustion residuals (CCR). On April 13, 2026, the EPA proposed to establish new provisions that would allow a CCR permit authority to establish alternative requirements. The EPA is considering whether a general permit could be developed to allow such facilities to temporarily obtain permit coverage until their state CCR permit program incorporates these new pathways and is approved.
