Attached please find comments of the National Mining Association on the U.S. Environmental Protection Agencys draft establishment of a numeric criterion for selenium for California. 83 Fed. Reg. 64059, (Dec. 13, 2018). NMAs comments include a cover letter as well as a document entitled "Technical Memorandum: Regarding EPA Proposal for New Water Quality Criteria for Selenium for California" prepared by GEI Consultants, Inc., which provides a more comprehensive critique of the draft California criterion. Abstract

EPA proposes to establish federal Clean Water Act water quality criteria applicable to waters under the state of California’s jurisdiction to protect aquatic life and aquatic-dependent wildlife from exposure to selenium. EPA’s proposed rule does not include waters in the San Francisco Bay Delta system that were previously covered in EPA’s June 2016 proposed rule (Water Quality Standards; Establishment of Revised Numeric Criteria for Selenium for the San Francisco Bay and Delta, State of California).
