Attached are the comments (and attached appendix A) of the National Pork Producers Council to EPA?s proposed CERCLA/EPCRA Administrative Reporting Exemption for Air Releases of Hazardous Substances from Animal Waste, Docket ID No. EPA-HQ-SFUND-2007-0469.
The Environmental Protection Agency (EPA) seeks to reduce the reporting burden under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and the Emergency Planning and Community Right to Know Act (EPCRA) for certain animal agricultural operations that release hazardous substances into the air from animal waste (manure). This action is being undertaken at the discretion of the Agency. The potential for a significant number of notifications to the National Response Center (NRC) for which there is an unlikely response places an unnecessary burden on the Federal government, dstate governments, local governments, as well as the facility owners and operators who are responsible for making the reports.
