The National Rural Electric Cooperative Association (NRECA) endorses the comments of the Utility Water Act Group (UWAG) in supporting the proposal of the Environmental Protection Agency (EPA) to postpone certain deadlines within the final 2015 Steam Electric Effluent Limitation Guidelines Rule (ELG rule). NRECA urges EPA to take final action (1) to postpone the compliance dates for the new, and more stringent, best available technology economically achievable ("BAT") effluent limitations and pre-treatment standards and (2) to retain the postponement until EPA completes reconsideration of the ELG Rule.
The National Rural Electric Cooperative Association (NRECA) submits these comments on EPA's recent Proposed Rule regarding the "Effluent Limitations Guidelines and Standards for the Steam Electric Power Generating Point Source Category" (78 Fed Reg 34432, June 7, 2013). NRECA has worked closely with our utility sector partners in the Utility Water Act Group (UWAG) and Utility Solid Waste Activities Group (USWAG) and endorses the extensive comments submitted by these organizations. NRECA also endorses the comments submitted by the United States Small Business Administration (SBA). NRECA urges EPA to: • Reconsider the potential impact of this rule on small entities, including the small distribution cooperatives that own the affected G&T cooperatives. • Reconsider the cost effectiveness of this rule, and to revise the final rule to promulgate standards based on $/TWPE comparable to those promulgated for other sectors. • Reopen the rulemaking – to collect additional data, correct errors in the cost models, update the cost-effectiveness analysis, and make the new data and analysis available for public review and comment. NRECA also recommends: 1.Continued wet handling of bottom ash in surface impoundments. 2.Continued wet handling of fly ash in surface impoundments. 3.Flue Gas Desulfurization (FGD) wastewater limits based on chemical precipitation, but only for plants with maximum design flow (mdf) rate greater than 200 gallons per minute (gpm). 4.Deferring regulation of gasification wastewaters. 5.Retaining the status quo for Nonchemical Metal Cleaning Waste (NCMCW). 6.Continued and expanded use of centralized wastewater treatment and measures to encourage recycling, re-use and conservation of water. 7.Regulating CCR impoundment unit integrity through RCRA and the CCR rule. 8.Harmonizing the final ELG rule with the Subtitle D Prime Option described in the CCR Proposal. 9.Giving permit writers the flexibility to allow sufficient time for plant modifications that may be required by the new rule. 10.Limiting the rule to units above 100 MW.

Abstract
EPA announced on September 15, 2009 the start of a rulemaking process to revise the effluent limitations guidelines and standards for the steam electric power generating point source category (i.e., steam electric power plants). EPA’s decision to proceed with a rulemaking was made upon reviewing the findings from a multi-year study of wastewater discharges from power plants.EPA’s review of wastewater discharges from power plants, and the treatment technologies available to reduce pollutant discharges, has demonstrated the need to update the current national effluent guidelines regulations. The current regulations, which were last updated in 1982, do not adequately address the pollutants being discharged and have not kept pace with changes that have occurred in the electric power industry over the last three decades.
