On behalf of the more than 3 million members and activists of the Natural Resources Defense Council, I write to urge the Environmental Protection Agency not to reverse its longstanding position that discharges to groundwater with a direct hydrologic connection to surface waters require permitting under the National Pollutant Discharge Elimination System program. Abstract

EPA is requesting comment on the Agency’s previous statements regarding the Clean Water Act that pollutant discharges from point sources that reach jurisdictional surface waters via groundwater or other subsurface flow that has a direct hydrologic connection to the jurisdictional surface water may be subject to CWA regulation.
